General sale conditions

Art. 1 - Acceptance of general sale conditions.

These general terms of sale (hereinafter referred to as "Terms") concern the purchase at distance of products, made available through the Internet on www.estiara.it (hereinafter "the Site" ") in compliance with Italian law as per D.Lgs 206/2005 of the Consumers Code (" Consumption Code ") and subsequent amendments and additions.

Before entering the order, the consumer who accesses the Site for purchase (hereinafter "Customer") is required to read carefully these General Terms and Conditions that have been made available on the Site and which can be consulted at any time.

These terms of sale ("Terms of Sale") and the information referred to in art. 59 of the Consumer Code, as reported by Sintetica during the sale to the Customer, will remain valid and effective if changes and / or additions are made by Sintetica. Any changes and / or additions to the Terms of Sale will be effective from the date on which they will be communicated to the public, and consequently applied to the sale from that date.

Art. 2 - Conclusion of the contract.

The contract between Sintetica and the Customer shall be considered concluded with the acceptance, even partial, of the purchase proposal made by the Customer through the Site based on the formalities described in the following paragraphs. The contract is finalized at the time of payment, with the purchase confirmation sent by mail to the Customer.

In the event of non-acceptance of the order, Sintetica will in any case provide immediate communication to the Customer.

By placing an order in the various ways provided, according to the order form on the Site (hereafter the "Order"), the Customer declares that he has seen all the information given to him during the purchase procedure and that accepts in their entirety these General Terms and Conditions (hereinafter the "Terms").

These Terms may be printed or saved on a durable basis, following the provisions of Art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

Art. 3 - Buying methods.

The products offered for sale by Sintetica are only the ones available on www.estiara.it at the time of the Order's submission, as described in the information sheets. However, it is understood that the images supplied with the product description are for informational purposes only and may not be perfectly representative of its features, but may differ, for example, by color and size (also based on the browser and monitor used to access the Site and visualize the images). The Customer must complete the order form on the Site and send it to after having carefully reviewed the Terms, as well as the characteristics of the product and / or the products that he intends to purchase. Prior to sending the Order, a printable summary page will be displayed, in which the essential data of the Order will be included, namely the buyer's generality, the details of the goods or goods purchased, the price, the shipping costs, the terms of payment, the place of delivery and the mention of the possibility of withdrawal. The Customer shall also inform Sintetica if an invoice relating to the purchase is needed, in accordance with art. 22 D.p.R. n. 633/1972. Correct receipt of the Order is confirmed by Sintetica by an e-mail sent to the e-mail address communicated by the Customer. This confirmation message will summarize the terms of purchase, as provided for by applicable law, as well as the data entered in the Order by the Customer, so that they can verify the same and, if necessary, communicate the necessary corrections of incorrect data without delay. The customer will have 24 hours to eventually terminate the Contract and, in doing so, obtain full refund of the amount paid without penalty and without any need to state any reason. Within 24 hours of sending the confirmation message, the Order will be processed for shipment and no changes will be accepted without prejudice to Customer's rights under Art. 6. In the case of a lack of availability of all or part of the goods ordered by the Customer, Sintetica, always by mail communication, will notify the temporary inability to execute the Order and the expected waiting time by requesting the Client whether to confirm or less the Order.

Art. 4 - Prices and Payment Methods.

The prices indicated on the site are to be considered as inclusive of taxes and VAT and constitute an offer to the public pursuant to art. 1336 c.c. Any shipping costs or payment charges will in any case be communicated to the customer in advance through the site, at the time of order, or through these Terms.

The customer will be given the option to choose between different payment methods, and no commission will be applied regardless of the method selected:

  • PayPal.
    PayPal can be used by PayPal for the payment according to the specific terms of the PayPal.
  • Credit card (on Stripe).
    In the case of purchasing goods with Credit Card payment methods, the transaction will take place via a secure PayPal server or other secure server selected by Sintetica. Under no circumstances and at any stage of the payment Sintetica will be able to know the Customer's credit card information, transmitted through a secure connection directly to the bank's website managing the transaction. None of these datas will be kept by Sintetica and therefore in no case Sintetica may be held liable for fraudulent and unlawful use of credit cards by third parties upon payment.
  • Bank Transfer
    To make a bank transfer, please use the following data:

In any case, in case of communications regarding payments, Sintetica will strictly comply with the privacy laws.

Art. 5 - Delivery of goods and related expenses.

Sintetica will send the Order, depending on the availability of the product as specified in paragraph 3, to the address provided by the customer within 5 days of the stipulation of the Contract.

During the creation of the eyeglasses, the Customer may be updated on the status of his Order by accessing the personal page on the Site (Account - Order).

The order expiration date may vary depending on the payment method chosen by the customer. During the holidays, there may be delays due to the closure of the company. Any change on the delivery date will be communicated to the Customer by e-mail.

Shipping expenses will be specifically indicated on the Site when placing the Order. Sintetica reserves the right to accept or not deliveries outside the Italian or European territories. In any case, for deliveries to be made outside the Italian borders, shipping charges and delivery times may vary.

Regarding the deliveries required in countries not belonging to the European Union, any import customs charges will be borne by the recipient. You are therefore asked to contact the customs authorities of your country in advance to check the costs and possible import limits.

The delivery times indicated by Sintetica must be considered as purely indicative and a delay or any delivery made with subsequent fractional shipments does not entitle the Customer to refuse the same delivery and to claim damages or compensation.

When the product or products are delivered, Customer is required to check:

  • if the number of packages delivered corresponds to what is stated in the shipping document
  • that the packaging is intact, not damaged, neither wet nor otherwise altered, even in the closure materials (adhesive tape).

Any damage to the packaging and / or the product or the lack of correspondence to the number of packages or indications must be immediately noted, giving a specific indication on the delivery document of the product to be returned to the courier.

Any problems regarding the physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery, as provided in this document.

Art. 6 - Right of withdrawal.

According to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may terminate the Terms and Conditions and therefore the Purchase Agreement without need to state reasons and without any penalty within 14 business days from the date of receipt of the products.

To exercise the right of withdrawal referred to in Article 5 above, Customer shall send Sintetica an e-mail, within the terms indicated, at info@estiara.it. or contact Sintetica Srl at 039.8943881 and/or 039.9910418.

The glasses that will be returned will be accepted in return as follow:

  • The goods must be intact and not damaged. Every frame is a unique piece and it may differ from the others in the same collection for the chromatic and aesthetic effects. That’s why we ask the Customer to handle the product with care if you wish to proceed with a refund.
  • The goods must be returned with their original packaging complete in all its parts (including packaging and any accompanying documentation and accessories: labels, tags, seals, etc.);
  • Copy of the receipt of the order must be included in the return expedition
  • the shipment, up to the receipt of the packaging, is under the full responsibility of the Customer.
  • if the goods are damaged during transport to the Customer, Sintetica will notify the Customer to promptly file a complaint against the selected courier and obtain the corresponding refund; The product will then be made available to the Customer, simultaneously canceling the withdrawal request;
  • Sintetica will not respond in any way for damage, theft, loss occurring during the shipment for return.

After Sintetica Srl has received and verified the items returned, it will proceed with a refund.

Refunds are:

  • total for orders from ITALY
  • partial of the amount paid (excluding transport costs) for orders coming from the EU and Rest of the World

The refund will be issued as follows, depending on how the Customer has chosen to settle the order, unless otherwise agreed:

  • Bank transfer: after communication of the banking coordinates, to be sent, with reference of the order made, to info@estiara.it
  • Paypal: Refund on the account used for the purchase
  • Credit Card: Transaction Transfer

Sintetica will refund the sum due within 14 (fourteen) days from the date of receipt of the goods, after verifying the integrity of the returned product/s.
The customer will receive an e-mail confirming your refund.
The time for your account to be credited may vary from bank to bank. In any case, the Customer will not bear any cost because of such reimbursement, except for the costs incurred if he or she did not use the standard procedure indicated for the return or in case the return does not come from Italy.

The Customer will be denied the right of withdrawal if Sintetica determines that:

  • the returned product and / or its accessories, and / or its packaging are not complete;
  • the product is missing its outer packaging and / or the original interior packaging;
  • the product lacks the same integrating elements and / or accessories.

Any product whch will be returned without following these directions given will not be accepted and will be sent back to the Customer, without any refund.

In case of loss of the right of withdrawal, Sintetica will return to the Customer the purchased product, also charging the shipping costs and, if already refunded, the price of the product.

Art. 7 - Customer Obligations.

The buyer asserts and attests: to be a consumer as reported in art. 3 of the Consumers Code, to be of age, that the details provided within this contract are correct and true.

Art. 8 - Resolution.

Non-payment by the Customer in the times and in the ways indicated in the Order's summary page and the guarantee of the good end of the purchase are essential elements of the contract with the consequence that the lack of any of these elements will result in ipso jure's termination of the contract Art. 1456 c.c.

Art. 9 - Guarantees.

All products sold by Sintetica are covered by the 21 (twelve) hour warranty for defects of conformity, as per Title III of D.Lg. 206/2005. To benefit from warranty service, Customer must keep the invoice, or the payment receipt, together with the shipping documents.

The Warranty for Compliance Failure will apply if the relevant product has been used correctly, in accordance with its intended use and with the instructions given with the product.

If, for any reason, Sintetica is unable to return the Customer a warranty product (restored or replaced), or if the repair or replacement will be too expensive considering the value of the product, Sintetica may proceed with the reasonable reduction of the price paid, that is to say, the refund of the entire amount paid with the subsequent termination of the contract.

In case the return of the product is needed, the product must be returned by the Customer in its original package, complete in all its parts (including packaging and any documentation).

Lenses Information.

In compliance with EC Directive 89/686/EEC and US FDA Reg. 21CFR 801.410.
Standard of reference EN ISO 12312-1.

Protection from sun radiation according to European Standard EN ISO 12312-1.

Category and type of filter: such indication is composed by a number and a letter:
The number indicates the category of the filter (protection against sun glare 0 = very limited, 1 = limited, 2 = good, 3 = high)
Estiara’s sunglasses belongs to category n. 2.
The letter indicates the type of filter (N = normal, P = polarized, F = photochromatic)
Estiara’s lenses’ filter is N.

For photochromatic lenses (F) the number indicates their category of use when they are tinted; when they are not tinted they belong to 1 category lower.

The lenses fitted in these sunglasses feature high optical precision and are impact resistant according to US FDA Reg. 21CFR801.410. They are not to be considered indestructible against strikes.
The frames are made of specially designed material to guarantee lightness, comfort and, at the same time, mechanical sturdiness.

Not suitable for direct viewing of the sun or for viewing solar eclipses; not suitable for use as protection against UV rays from artificial light sources (e.g. tanning beds); not suitable for use as eye protection against blow or impacts; not suitable for driving at night or in poor visibility conditions.

To clean your sunglasses, use water and soap avoiding all types of solvent or alcohol. Do not use dirty or abrasive cloths which could alter the feature of their filters.
Use only original accessories and spare parts.

Keep in the cloth or hard case in a dry place at a temperature between -10°C and +35°C.

Art. 10 – Exemption of liability.

Sintetica does not take any responsibility for any disruption due to causes of force majeure or in any case not attributable to them, with particular reference to the failure to execute the Order in due time due to causes related to the use of the Internet, be it out of work.

In this case Sintetica will not be obliged to pay damages or to reimburse costs by limiting the Customer's right to the full refund of the price paid.

Art. 12 - Privacy.

The personal data collected with the Order will be processed by Sintetica only for satisfying the express requests of the Customer, in compliance with Legislative Decree 196/2003 and the privacy statement on the site. Any further processing will only be approved with the express consent of the Customer.

Art. 13 - Applicable Law and Court.

The sales contract referred to in these Terms is understood to be concluded in Italy and is governed by the Italian Law.

For the settlement of any disputes relating to the application, execution, interpretation and violation of the contract

the jurisdiction belongs to the Court connected to the municipality where the Customer resides or lives, if within the Italian territory; in all other cases the jurisdiction will be exclusive of the Court of Lecco.

Art. 14 - Copyright.

Trademarks, logos and other distinctive signs on the Site belong to their respective owners. The use of trademarks, logos and other distinctive signs, including reproduction on other websites by unauthorized third parties, is prohibited. The contents of this site are protected by copyright (texts, images and graphics).

Art. 15 - Agreement.

The contract supersedes all previous agreements and understandings between the parties and constitutes the entire agreement between the parties about the contract, together with the Order, the general Terms and Conditions of use of the site and the Terms and Conditions regarding the registration service. Any variation or modification of the contract must be accepted in writing by both parties.

Art. 16 - Communications.

All communications between the parties must be written and sent to the address of the other party indicated in the contract and in the Order.

Art.17 - Language.

This contract is drawn up in two versions: Italian and English.

For any differences in translation, the Italian version will prevail.

The parties state that they have specifically discussed and expressly approved for the purposes and for the effects of art. 1341 and 1342 c.c. the following contract terms: Art. 1 - Acceptance of the general sale conditions; Art. 2 - Conclusion of the contract; Art. 3 – Buying methods; Art. 5 - Delivery of goods and related expenses; Art. 6 - Right of withdrawal; Art.8 - Resolution; Art. 10 - Exemption of liability; Art. 13 - Applicable Law and Court.
